In Georgia, every driver is required to have a minimum of $25,000 in liability coverage. This means that if someone injures another party, and the damage is $25,000 or less, the insurance policy will cover the entire amount of damages. There are also other tiers of coverage of $50,000, $100,000 and $250,000 and there are “umbrella policies” that cover any type of negligence by the insured party.

With every injury case, it is very important to know the liability limits on the case. Therefore, it is important to check for all available insurance policies and know what there coverage levels are. A Knowledgeable Accident and Injury Attorney can help you determine what insurance is available.

An example: If someone is injured and has $75,000 in damages and the insurance policy of the driver who caused the accident is only $25,000, then there is a shortfall of $50,000. This $50,000 shortfall can be made up by personal assets of the driver, UM Insurance (UM for Underinsured or Uninsured Motorist), an umbrella policy, or other avenues such as other insurance policies that might be in place. If there are no other avenues outside of the $25,000 liability coverage, then the Plaintiff gets left holding the bag on the remaining $50,000 in damages. This is why it is extremely important in an auto accident case that all avenues of compensation are found and explored and thoroughly used so the plaintiff is not left in an unfair situation.
